Transformation Coaching, LLC (“Company”, “us”, “we”, or “our”) is a Florida limited liability company committed to safeguarding your online privacy with respect to certain information that we may obtain from you at the http://www. BECKYEADESPHD.COM website (the “Website”). Our Privacy Policy (“Privacy Policy”) provides answers to your questions regarding your online privacy, including what information we may obtain from you and how it will be used and protected. The Company may from time to time change this Privacy Policy, so please check back periodically.

We use your Personal Information for providing and improving the Website and the service provided therein. Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our Website and service. By accessing or using our Service and website, you agree to this Privacy Policy. 

This Privacy Policy is governed by the laws of the State specified in the Terms and Conditions of Use applicable to the Website and the services provided therein. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms and Conditions of Use, accessible on our Website.

1. What information do we collect and what do we do with it?

a. Information you provide to us. While using our Website and the services provided pursuant to the Website, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally, identifiable information may include without limitation, your name, address, e-mail address, phone number, credit card information, and purchase history. We collect this information for purposes of providing services, identifying and communication with you, responding to your requests/inquiries, servicing your purchase and improving our services and the Website. You may also provide information to be published or displayed (hereinafter, “posted”) on public areas of the Website, on any public forum including without limitation any social media page (whether your own or the Company’s) or transmitted to other users of the Website or third parties (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Website with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

b. Other Information We Receive and Store. We also collect and receive information that your browser sends whenever you visit the Website (“Log Data”). This Log Data may include information such as your computer’s Internet Protocol (“IP) address, your email address, your browser type and version, your operating system and platform, your purchase history, products you view, products you search for, length of visits to pages and other browser interaction information. In addition, we may use third party services including without limitation Google Analytics that collect, monitor, and analyze this type of information in order to increase our Website’s and the services’ provided therein, functionality. These third-party service providers have their own privacy policies addressing how they use such information. 

c. Cookies. The Website’s pages or email messages may contain cookies, web beacons (also known as clear gifs), or similar technologies as they become available.  Cookies are information files that this Website may place on your computer to provide extended functionality. The Website may use cookies for a number of purposes, such as tracking usage patterns on the Website, measuring the effectiveness of advertising, limiting multiple responses and registrations, facilitating your ability to navigate the Website and as part of a verification or screening process. Most browsers are initially set up to accept cookies. Most browsers will allow you to erase cookies from your computer hard drive, block acceptance of cookies, or receive a warning before a cookie is stored. You should refer to your browser instructions, “Help” screen, or similar such resource to learn more about how to manage cookies and possibly reset your browser to refuse all cookies or to indicate when a cookie is being sent by indicating this in the preferences, options, or similar such menu in your browser. However, it is possible that some parts of this Website will not operate correctly if you disable cookies and you may not be able to take advantage of some of this Website’s features. d. Third-Party Advertisements. The Website and Website Owner’s web pages may include advertisements for third parties and their products, and those third-party advertisements may include a cookie or web beacon served by the third party. The Website and Website Owner does not control cookies in such third party ads, and visitors are encouraged to check the privacy policies of advertisers and/or ad services to learn about their use of cookies and other technology.  The Website and Website Owner’s Privacy Policy does not cover the use of information collected from you by third party ad servers.  These companies may use information (not including your name, address, email address, or telephone number) in order to provide advertisements on this Website and other websites about goods and services that may be of interest to you. 

e. Web beacon. A web beacon is a small graphic image that allows the party that set the web beacon to monitor and collect certain information about the viewer of the web page, web-based document or e-mail message, such as the type of browser requesting the web beacon, the IP address of the computer that the web beacon is sent to and the time the web beacon was viewed. Web beacons can be very small and invisible to the user, but, in general, any electronic image viewed as part of a web page or e-mail, including HTML based content, can act as a web beacon. The Website and Website Owner may use web beacons to count visitors to the web pages on the Website or to monitor how our users navigate the WEBSITE, and the Website and Website Owner may include web beacons in e-mail messages in order to count how many messages sent were opened, acted upon or forwarded.

f. DO NOT TRACK DISCLOSURE. THE COMPANY DOES NOT SUPPORT DO NOT TRACK (“DNT”). 

2. Use and Disclosure of Information We Collect. 

a. Use of your Information. We use information that we collect about you or that you provide to us, including any personal information: (i) to present our Website and its contents to you; (ii) to provide you with information, products or services that you request from us; (iii) to fulfill any other purpose for which you provide it; (iv) to provide marketing or class information about our site related to courses, classes, retreats, or other types of registrations, course content, your progress, or other updates; (v) to inform you about changes to the course, survey you about your usage, or collect your opinion; (vi) to provide you with notices about your account, including expiration and renewal notices; (vii) To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection; (viii) to notify you about changes to our service or any products or services we offer or provide though it; (ix) to allow you to participate in interactive features on our Service; (x) to provide you with newsletters, marketing, or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all of these communications from us by following the unsubscribe link or instructions provided in any email we send; (xi) in any other way we may describe when you provide the information; and (xii) for any other purpose with your consent. 

b. Disclosure of your Information. We may disclose aggregated information about our users, and information that does not identify any individual, without restriction. We may disclose personal information that we collect or you provide as described in this privacy policy: (i) to our subsidiaries and affiliates; (ii) To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them; (iii) to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by the Company about our users is among the assets transferred. In such cases, we will provide notice before your personal information is transferred and/or becomes subject to a different Privacy Policy; (iv) to fulfill the purpose for which you provide it; (v) for any other purpose disclosed by us when you provide the information; (vi) with your consent; (vii) to comply with any court order, law, or legal process, including to respond to any government or regulatory request; (viii) To enforce or apply our Terms and Conditions of Use of our Website. and other agreements, including for billing and collection purposes; and (ix) If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company our customers/clients, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

c. Choices About How We Use and Disclose Your Information. We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

  1. Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of the Website and/or our services may then be inaccessible or not function properly.

  1. Promotional Offers from the Company. If you do not wish to have your email address used by the Company to promote our own or third parties’ products or services, you can opt-out by sending us an email stating your request to info@[email protected]. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt out does not apply to information provided to the Company as a result of a product purchase, warranty registration, product service experience or other transactions.

  1. We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way.

3. Accessing and Correcting Your Information.  You can review and change your personal information by logging into our Website and visiting your account profile page. You may also send us an email at info@[email protected] to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. If you delete your User Contributions from the Website, copies of your User Contributions may remain viewable in cached and archived pages or might have been copied or stored by other Website users. Proper access and use of information provided on the Website, including User Contributions, is governed by our Terms and Conditions of Use policy on our Website.

4. Thinkific. Our course and site are hosted by Thinkific Labs Inc. (“Thinkific”). They provide us with the online course creation platform that allow us to sell our product/services to you. Thinkific may collect cookies and collect your data in other ways including when you sign up for the Website. Your data is stored through Thinkific’s data storage, databases and the general Thinkific application. They store your data on a secure server behind a firewall. 5. Payment. If you make a purchase on Website, we use a third-party payment processor called Stripe. Payments are encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our site and related courses and its service providers.

6. Ontraport. We use a marketing automation platform called Ontraport.  Ontraport utilizes standard industry firewall and other protective measures to ensure the safety of your personal data. Ontraport is used to to integrate payment gateways like Stripe, it is PCI-DSS (Payment Card Industry Data Security Standard) compliant.    

7. International Transfer. Your information, including Personal Information, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction. If you are located outside United States and choose to provide information to us, please note that we transfer the information, including Personal Information, to United States and process it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

8. Third Party Services. In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies, so you can understand the manner in which your personal information will be handled by these providers. Certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. If you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

9. Links to Other Sites. Our Website may contain links to other sites that are not operated by us. If you click on a third-party link, you will be directed to that third party's site. We strongly advise you to review the privacy policy of every site you visit. We have no control over, and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.

10. Security. To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

11. Children’s Privacy. Only persons 18 years of age or older have permission to access our Website and the services we provide. You must be 18 years of age or older to subscribe to our Website and/or services. 

12. California Privacy Rights. California Civil Code Section § 1798.83 permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. 13. Data Retention. We only retain the personally identifiable information from a Client for as long as the Client’s account is active or otherwise for the limited purpose for which we have initially collected it, unless otherwise required by law. 

14. Consent. When you provide us with personal information on our Website, make a purchase, or participate in the course, you declare that you have read and accepted the terms of this Privacy Policy. Additionally, by providing information on the Website, making a purchase, or participating in the course, you are providing consent to our collecting your information, including without limitation, personally identifiable information, and using it for that specific reason only. If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no. If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at any time, by contacting us at [email protected].

15. Changes to this Privacy Policy. This Privacy Policy is effective as of March 1, 2019. We reserve the right to modify this Privacy Policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the Website. Your continued use of the Website after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy. If our Website or course is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
